Patents Korea A Korean employee does not own 'in-service' invention Mr. Choi, an employee of Samsung Electronics invented a letter input device (Korean letter keyboard) during his employment with the company. Subsequently, he sued Samsung for allegedly obtaining a patent on the device and claimed profits earned by the company by using the alleged patent. The Court held that the profits of Samsung Electronics legitimate on the basis that the invention falls under the category of 'in-service invention' since the product was developed during the course of Choi's employment with the company. |
